The Higher Court in Podgorica has decided to release businessmen Ranko Ubović and Vladan Ivanović from custody, a move that has sparked controversy regarding the legality of their detention. The ruling comes after the Special State Prosecutor’s Office (SDT) stated that the decision to lift the detention was unlawful. Defense attorney Nikola Ivanović expressed his surprise at this assertion, emphasizing that the court’s ruling was valid and lawful.
During a recent hearing, the SDT conducted witness testimonies, which enabled the judges to make an informed decision regarding the release of the two defendants. Ivanović noted that there was no legitimate reason for their initial detention, arguing that there is no substantial evidence suggesting that either individual committed a crime, particularly the charges they face.
Ivanović stated, “I believe there was absolutely no reason for the detention of these individuals, nor should their custody have been a consideration at all. There is no founded suspicion that they have committed any criminal act.” He also mentioned that further discussions on the matter will take place in court when the time is appropriate.
In response to the SDT’s announcement that the release was unlawful, Ivanović reiterated his surprise, as he believes this contradicts established legal practices in similar cases. He opted not to elaborate further on the SDT’s statement but maintained that the court’s decision is entirely justified and will be subject to review if the SDT files an appeal.
“The law provides for such possibilities,” Ivanović said. “This announcement surprises me, but we remain open to the input of higher instances, which will ultimately provide clarity on this matter.”
